Welcome to SpatioWorld Track (Wenotix Safe).

Application means the SpatioWorld Track (Wenotix Safe) mobile application available for Android and iOS.

Device means any computer, smartphone, tablet, GPS tracker, IoT device, vehicle tracking device, or other hardware capable of accessing or transmitting data to the Services.
GPS Device means any compatible hardware capable of transmitting location information to the Services.
Service means the SpatioWorld Track (Wenotix Safe) website available at https://track.spatioworld.com, web applications, Android and iOS mobile applications, APIs, customer portal, fleet management platform, personal safety platform, GPS tracking services, and all related software, features, and services provided by the Company.
User means any individual accessing or using the Services.
2. Eligibility
You must be at least 18 years of age and legally capable of entering into a binding agreement to use the Services.
If you register on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
3. Acceptance of Terms
By creating an account, installing the Application, or using any Service, you acknowledge that you have read, understood, and agreed to these Terms and our Privacy Policy.
If you do not agree with these Terms, you must discontinue use of the Services immediately.

Certain features may require an active subscription.
5. User Accounts
To access certain features, you must create an account.
You agree to:

Provide accurate and complete information.

Keep your information updated.

Maintain the confidentiality of your password.

Notify us immediately of unauthorized account access.

Accept responsibility for all activities conducted through your account.
Passwords are securely hashed and cannot be recovered by the Company.
6. GPS Tracking
The Services allow Users to collect, store, and display GPS location data.
You represent and warrant that:

You have lawful authority to track any person, vehicle, or asset added to your account.

You will obtain all legally required consents before tracking another individual.

You will comply with all applicable privacy and surveillance laws.
You are solely responsible for ensuring that your use of GPS tracking complies with applicable laws.
The Company is not responsible for unlawful or unauthorized tracking conducted by users.
7. Acceptable Use
You agree not to:

Use the Services for illegal purposes.

Track individuals without lawful authority or required consent.

Attempt unauthorized access to our systems.

Reverse engineer or interfere with the Services.

Upload malware or malicious software.

8. Subscription and Billing

Subscription plans may automatically renew unless cancelled before the renewal date.

All intellectual property rights in the Services, including software, source code (excluding open-source software), trademarks, logos, graphics, documentation, and content remain the exclusive property of Spatioworld Technologies Private Limited or its licensors.

Each component remains subject to its respective license.
11. Maps and Geocoding Services
The Services include:

Mapping information is provided for convenience only.
The Company does not guarantee the completeness, accuracy, or availability of mapping or geocoding information.
12. Third-Party Services
The Services may integrate with:

Google Play Services

Apple App Store
-
Payment providers
-
Email providers
-
Cloud infrastructure providers
-
Push notification services
-
GPS device manufacturers
Your use of third-party services may also be governed by their respective terms.
13. User Content
You retain ownership of any information, GPS data, documents, reports, or other content uploaded to the Services.
By submitting content, you grant the Company a non-exclusive, worldwide, royalty-free license to process and use such content solely for operating, maintaining, securing, and improving the Services.
14. Service Availability
While we strive to provide reliable Services, interruptions may occur due to maintenance, internet failures, hardware failures, software defects, force majeure events, or third-party outages.
We may modify, suspend, or discontinue any feature where reasonably necessary.
15. Software Updates
The Company may release updates, bug fixes, security patches, or new versions of the Services.
You agree to install updates required for security, compatibility, or continued operation.
16. Account Suspension and Termination
We may suspend or terminate your account if:

Subscription fees remain unpaid.

17. Disclaimer of Warranties

We do not guarantee uninterrupted availability, GPS accuracy, mapping accuracy, geocoding accuracy, or that every software defect can be corrected.
18. Limitation of Liability
To the fullest extent permitted by law, the Company shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages.
Our total liability shall not exceed the amount paid by you during the preceding twelve (12) months or INR 10,000 (or USD 100 equivalent), whichever is greater, unless otherwise required by law.
19. Indemnification
You agree to indemnify and hold harmless the Company from claims arising from:

Misuse of the Services.

Violation of these Terms.

Violation of applicable laws.

Unauthorized GPS tracking.

Infringement of third-party rights.

Content uploaded through your account.
20. Privacy
Your use of the Services is governed by our Privacy Policy available through https://track.spatioworld.com.
21. Governing Law
These Terms are governed by the laws of the Republic of India and the State of Maharashtra.
22. Dispute Resolution
Disputes should first be resolved through good-faith negotiations.
If unresolved within thirty (30) days, disputes shall be subject to the exclusive jurisdiction of the courts located in Pune, Maharashtra, India.
23. Compliance with Laws
You agree to comply with all applicable laws governing GPS tracking, privacy, telecommunications, transportation, surveillance, and data protection.
24. International Users
Users accessing the Services outside India are responsible for compliance with their local laws.
25. Export Control and Sanctions
You agree to comply with all applicable export control, sanctions, and trade laws.
26. Force Majeure
The Company shall not be liable for delays caused by events beyond its reasonable control, including natural disasters, pandemics, war, cyberattacks, power failures, internet outages, or government actions.
27. Suspension of Services
We may temporarily suspend Services for maintenance, upgrades, security incidents, or legal compliance.
28. Entire Agreement
These Terms, together with our Privacy Policy and related legal documents, constitute the entire agreement between you and the Company.
29. Severability
If any provision is held unenforceable, the remaining provisions shall remain in full force.
30. Waiver
Failure to enforce any provision does not constitute a waiver of that provision.
31. Assignment
You may not assign your rights without our written consent.
The Company may assign these Terms in connection with a merger, acquisition, restructuring, or sale of assets.

Material changes will be communicated through our website, application, or email where appropriate.
33. Electronic Communications
By using the Services, you consent to receive electronic communications including account notifications, billing notices, legal notices, security alerts, and policy updates.

35. Acceptance of Terms
By accessing, browsing, registering for, installing, or using the SpatioWorld Track (Wenotix Safe) website, web application, mobile application, APIs, GPS tracking services, or related Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
Nothing in these Terms grants ownership of any intellectual property rights.
